Book Description

It was not until the mid-twentieth century that childhood achieved recognition as a developmental stage separate from adulthood. Despite the legal protections (e.g., child labor laws) for children that have been established since then, we’re still relatively early in the process of discovering childhood’s legal and forensic contexts. Taking us a quantum leap forward is this practical textbook, a step-by-step guide that walks clinicians through the often-confusing world of depositions and courtroom testimony. The editorsApioneers in child and adolescent forensic psychiatryAhave dramatically expanded their earlier textbook (Clinical Handbook of Child Psychiatry and the Law), bringing clarity and coherence to these complex and often highly charged clinical and legal issues by emphasizing evidence-based research within an easy-to-read outline format. Structured around clinical case examples, countertransference pitfalls, and guidelines for action, -Part 1, Basics reviews the history and principles of law (forensic ethics, psychological testing, and testifying in court) of forensic psychiatry and provides a framework for approaching forensic evaluations (including vicarious traumatization). -Part II, Child Custody talks about how to approach child custody disputes (including current social dilemmas that pose ethical and clinical questions for the forensic examiner), evaluations and assessments, foster care and adoption, termination of parental rights, and transracial/transcultural adoption in the United States. -Part III, Child Abuse presents new information on the developmental aspects of memory in children, the reliability and suggestibility of children’s statements, interview techniques, Munchausen syndrome by proxy, sexual harassment in school-age children, and child pornography. -Part IV, Youth Violence details how violence affects the child’s developing brain (setting the stage for conduct disorders, dissociative disorders, and posttraumatic stress disorder), assesses the risks of carrying weapons, and summarizes youth risk factors, common evaluation pitfalls, and prevention and intervention programs. -Part V, Juvenile Offenders highlights the differences between the content and application of juvenile and adult law, addressing the waiver of juveniles to adult court, effective early detection and intervention programs, and techniques for helping the especially problematic sexually aggressive youth. -Part VI, Legal Issues reviews the treatment of minors, the current state (including recent court decisions) of psychiatric commitment of minors, special issues for mentally retarded children, and psychic trauma and civil litigation. Even clinicians who plan never to set foot in court will want to have this reference on hand. Rich in both historical detail and practical guidance, this remarkable collection by top authors and clinicians in the field is the definitive reference (and preparation guide for board certification in forensic psychiatry) for practitioners, forensic examiners, attorneys and judges, and trainees in child and adolescent psychiatry and psychology.

Book Description

An international panel of experts from diverse specialties examine the idea of “evil” in a medical context, specifically a mental health setting, to consider how the concept can be usefully interpreted, and to elucidate its relationship to forensic psychiatry. The authors challenge the belief that the concept of “evil” plays no role in “scientific” psychiatry and is not helpful to our understanding of aberrant human thinking and behavior. Among the viewpoints up for debate are a consideration of organizations as evil structures, the “medicalization” of evil, destruction as a constructive choice, violence as a secular evil, talking about evil when it is not supposed to exist, and the influence of evil on forensic clinical practice. Among the highlights are a psychological exploration of the notion of “evil” and a variety of interesting research methods used to explore the nature of “evil.”

Book Description

Introduction to Veterinary and Comparative Forensic Medicine is a ground-breaking book in an emerging new speciality. It reflects the increasing demand for expert opinion by veterinarians and others in courts of law and elsewhere on such matters as:

wildlife conservation,

welfare of, and alleged cruelty to, animals,

insurance, certification and malpractice

the identification of live and dead species or their derivatives. It also discusses and analyses current concern over possible links between domestic violence and abuse of animals. Throughout the book the emphasis is on the need for a systematic and thorough approach to forensic work. A particular feature is practical advice, with protocols on dealing with common problems, together with case studies, various appendices and an extensive bibliography.

A vital reference for members of the veterinary profession, lawyers, enforcement bodies and welfare and conservation organisations. The comparative aspects provide an important source of information for those working in human forensic medicine and the biological sciences.

Book Description

This book provides a primary reference source for nuclear forensic science, including the vastly disciplinary nature of the overall endeavor for questioned weapons of mass destruction specimens. Nothing like this exists even in the classified material. For the first time, the fundamental principles of radioforensic analysis, all pertinent protocols and procedures, computer modeling development, interpretational insights, and attribution considerations are consolidated into one convenient source. The principles and techniques so developed are then demonstrated and discussed in their applications to real-world investigations and casework conducted over the past several years.

Sana Loue explores the concepts of legal and epidemiological causation, the use of epidemiological data based on populations to determine causation in an individual case, and the use of epidemiological evidence in litigation, including the reliance on experts and expert witnesses.

Loue provides a guide for the attorney with little or no background in epidemiological theory and for the epidemiologist contemplating a new role as an expert witness. She assumes of her readers a working knowledge of the Federal Rules of Civil Procedure and the Federal Rules of Evidence.

Discussing the epidemiologist as expert witness, Loue covers the nature of that testimony, the purpose of the testimony, and the qualifications necessary to be regarded as an expert witness. She examines various legal theories of causation, primarily in the context of product liability and toxic tort, and addresses epidemiological principles and methods used in the process of causal inference.

Loue also focuses on legal mechanisms used to assess causation. Her concern here is with depositions and testimony and the preparation of epidemiology experts. She concludes her study by comparing the legal and epidemiological concepts of causation, using actual legal cases as examples.

Throughout the text, Loue incorporates excerpts from depositions, interrogatories, and trial testimony to provide concrete examples. She also sets up an appendix to provide nonattorney readers with an overview of the legal system. Ultimately, her goal is to foster a greater understanding between law and epidemiology.
